These Terms of Service (hereinafter "Terms") govern all agreements relating to the use of the EPOS-AI Software-as-a-Service platform (hereinafter "Service") between Marcel Tobien, Weihermattweg 6, 6353 Weggis, Switzerland (hereinafter "Provider") and the user (hereinafter "Customer").
By registering for or using the Service, the Customer accepts these Terms in full.
The Provider offers the Customer a web-based AI-powered writing platform. The specific features available depend on the subscription tier selected (Starter, Professional, or Studio).
The Provider strives for high availability but does not guarantee it. Outages may occur due to failures of the underlying AI services (Anthropic Claude API), maintenance, force majeure, or overload. No claim for damages due to outages exists unless the outage lasts more than 30 consecutive days.
The Service uses the Anthropic (Claude) AI API. The Provider is not responsible for outages, changes, or discontinuation of the Anthropic API, the quality of AI-generated content, or changes to API pricing. If Anthropic significantly increases costs, the Provider reserves the right to adjust prices or discontinue the Service with 30 days' notice.
The contract is formed upon registration and payment. The Customer must be at least 18 years of age and have full legal capacity.
The monthly subscription has a term of one month and renews automatically for successive one-month periods unless the Customer cancels before the end of the current billing period. Cancellation can be made at any time via the customer portal or by email to info@epos-ai.ch. Access remains active until the end of the paid period.
The annual subscription has a term of twelve months from the date of purchase. Payment is made as a single upfront payment. The annual subscription renews automatically for a further twelve months unless the Customer cancels at least 14 days before the end of the term. Cancellation can be made via the customer portal or by email to info@epos-ai.ch.
No pro-rata refunds are provided for early cancellation of annual subscriptions, except where the EU right of withdrawal under Section 3.5 applies.
The Starter monthly subscription may begin with a free 7-day trial. If not cancelled before the trial expires, the subscription automatically converts to a paid monthly subscription. No free trial is offered for annual subscriptions.
Consumers resident in the European Union have the right to withdraw from the contract within 14 days without giving any reason, in accordance with EU Directive 2011/83/EU. The withdrawal period begins on the date of contract formation. Withdrawal must be communicated by email to info@epos-ai.ch.
If the Customer expressly requests that the Service begins immediately and acknowledges this right of withdrawal, the right may expire upon full performance of the contract. In the event of a valid withdrawal, a pro-rata refund for services rendered up to the date of withdrawal will be provided.
Swiss customers do not have a statutory right of withdrawal under Swiss law (OR) in this context.
Upon cancellation, access continues until the end of the paid period. No pro-rata refunds are given (except under EU withdrawal rights). Customer data is deleted after 30 days (backup retention period).
Current prices are listed on the pricing page at epos-ai.ch. All prices include applicable VAT. EPOS-AI offers both monthly and annual subscriptions. Annual subscriptions provide a discount compared to monthly billing.

Payment is made in advance by credit card through the payment processor Stripe — monthly for monthly subscriptions, as a single payment for annual subscriptions. Access is suspended in the event of payment failure.
The Provider reserves the right to adjust prices, particularly in the event of increased third-party API costs, changes to VAT, or general cost increases. Price increases will be announced by email 30 days in advance. The Customer has a special right of cancellation. For annual subscriptions, new prices only take effect at the next renewal.
The Customer receives a non-exclusive, non-transferable right to use the Service for their own purposes.
The following are prohibited: reverse engineering or reproduction of the Service, automated mass queries, sharing or reselling access, generating illegal or copyright-infringing content, circumventing technical safeguards or rate limits.
The Customer is responsible for the confidentiality of their credentials and is liable for all actions taken under their account.
Any attempt to circumvent payment requirements or gain unauthorised access to the Service is prohibited. This includes API manipulation, token forgery, subscription bypass, rate limit circumvention, account sharing, use of stolen payment methods, and chargeback fraud.
Proven fraud results in immediate account suspension without prior notice. The Provider reserves the right to pursue civil damages and criminal charges under Swiss law (Art. 147 and Art. 143bis Swiss Criminal Code). A contractual penalty of CHF 5,000 per incident may be imposed.
Creating multiple accounts to circumvent limits is prohibited. The Provider reserves the right to merge or suspend such accounts.
Each subscription includes a monthly token allowance. Current limits:

Limits apply equally to monthly and annual subscriptions.
When the monthly allowance is reached, access to AI features is restricted until the next billing period. Additional tokens may be purchased as add-ons.
Additional technical limits apply: a maximum of 60 requests per minute and a maximum of 3 concurrent sessions.
The Provider is not liable for the accuracy, completeness, or quality of AI-generated text. The Customer is solely responsible for reviewing all content before publication.
The Provider's liability is limited to intent and gross negligence. Liability for lost profits, indirect damages, or consequential damages is excluded. In all cases, liability is limited to the fees paid in the last twelve months, up to a maximum of CHF 10,000.
The Customer indemnifies the Provider against all third-party claims arising from the use of the Service, including copyright infringement, plagiarism claims, or violation of personal rights.
The Service is provided "as is". The Provider guarantees neither error-free operation nor the commercial suitability of generated content.
The Customer retains all rights to texts created using EPOS-AI, to the extent that such texts are protectable under copyright law. The legal status of AI-generated content varies internationally and is evolving.
The Provider does not guarantee that generated content is entirely original or bears no resemblance to existing works. The Customer is responsible for conducting plagiarism checks before publication.
The Provider may use anonymised usage statistics for product improvement. Customer texts are not used for AI training.
Details on data processing are set out in the Privacy Policy. The Provider strives for the highest security standards. Customers are advised to maintain their own backups.
The Provider may terminate the contract without notice in the event of a breach of these Terms, payment default exceeding 14 days, abuse of the Service, or threat to system security.
The Provider reserves the right to discontinue the Service with 90 days' notice. In the event of discontinuation, a pro-rata refund for the unused period will be provided — for both monthly and annual subscriptions.
The Provider may make updates or modify features at any time. Customers have no entitlement to the continuation of specific features.
If any provision of these Terms is found to be invalid, the remaining provisions remain in full force and effect.
All legal relationships are governed exclusively by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and conflict of laws rules.
The exclusive place of jurisdiction for all disputes is Lucerne, Switzerland.
The Provider reserves the right to amend these Terms at any time. Amendments will be communicated by email and are deemed accepted if the Customer does not object within 30 days. In the event of an objection, the contract terminates at the earliest possible date.
