These Terms of Service ("Terms") govern all agreements for the use of the EPOS-AI Software-as-a-Service platform ("Service") between Marcel Tobien, Weihermattweg 6, 6353 Weggis, Switzerland ("Provider") and the user ("Customer").
By registering or using the Service, the Customer accepts these Terms in full.
The Provider makes available a web-based AI-assisted writing platform. The exact scope of features depends on the selected subscription tier.
The Provider aims for high availability but does not guarantee it. In particular, the following may cause outages:
No right to compensation or refund exists for outages, unless the outage lasts more than 30 consecutive days.
The Service uses the AI API from Anthropic (Claude). The Provider is not responsible for:
The contract is formed upon registration and payment of the first monthly fee. The Customer must be of legal age (18 years) and legally capable of entering into contracts.
Consumers residing in the European Union or United Kingdom have the right to withdraw from this contract within 14 days without giving any reason, pursuant to EU Directive 2011/83/EU and the UK Consumer Contracts Regulations 2013.
The withdrawal period is 14 days from the date of contract conclusion (date of first payment). To exercise this right, please send a clear statement to info@epos-ai.ch (e.g.: "I hereby withdraw from my contract with EPOS-AI, concluded on [date]").
The subscription renews automatically each month. Cancellation is possible at any time via the in-app settings or by email. The cancellation takes effect at the end of the current billing period.
Current pricing is shown on the EPOS-AI website. All prices are in USD (US customers) or CHF/EUR (European customers) and are charged monthly.
Payments are processed by Stripe. The Provider does not store any credit card data on its servers.
The Provider reserves the right to change prices. Customers will be notified at least 30 days in advance by email. If the Customer does not cancel within this period, the new price applies.
Each subscription tier includes defined monthly word limits and daily usage caps. These limits are shown in the app. Exceeding limits results in temporary suspension of AI features until the next reset period.
The Service is intended for individual authors writing their own creative works. The following are prohibited:
The Customer agrees not to use the Service to generate content that:
Violations may result in immediate termination of access without refund.
Details on data processing are set out in the Privacy Policy.
Your texts are not used to train AI models. Your content belongs to you.
The Customer retains all rights to texts created with EPOS-AI, to the extent these are protected by copyright.
The Provider does NOT guarantee that generated content:
The Provider may use anonymised usage statistics to improve the product. Customer texts are NOT used for AI training.
The Service is provided "as is". The Provider makes no warranty regarding:
The Provider's liability is limited to wilful misconduct and gross negligence. Liability for lost profits, indirect damages, or consequential loss is excluded.
In all cases, liability is capped at fees paid in the preceding 12 months, up to a maximum of CHF 10,000.
The Provider may terminate the contract immediately upon:
The Provider reserves the right to discontinue the Service with 90 days' notice, in particular due to:
Upon discontinuation, a pro-rated refund for the unused period will be issued.
These Terms are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods and conflict of law rules.
The exclusive place of jurisdiction for all disputes is Lucerne, Switzerland.
For EU and UK consumers, mandatory statutory rights under applicable consumer protection law remain unaffected by this choice of jurisdiction.
The Provider reserves the right to amend these Terms at any time. Changes will be announced by email and are deemed accepted unless the Customer objects within 30 days.
